October 11, 2012 (HYANNIS) _ The Alliance to Protect Nantucket Sound is continuing its battle against Cape Wind.

Their latest lawsuit claims the offshore wind farm would violate the Endangered Species Act by destroying habitat for whales, sea turtles and migratory birds.

That brings the number of federal lawsuits facing Cape Wind up to 5. 

A Cape Wind spokesman says the filings this week are not new – and are part of a lawsuit previously filed in federal court.

The company also disputes assertions from the Alliance that the 130-turbine project will never be built.
