
ORLEANS - The man charged with burning down the Cape Cod Bible Alliance Church in Brewster Friday made his first public appearance in Orleans District Court Monday.29-year-old Adam Finnegan, flanked by his attorney and a court officer, said nothing as the proceedings unfolded.
He was not arraigned, but instead ordered to undergo a 20-day psychiatric examination to determine his competency to stand trial.
After that a dangerousness hearing will be held.
He is due back in court on December 19th.

Box truck crash on Mid-Cape Highway

Rescuers had to cut down several small trees to make room to extricate one victim, reportedly with serious leg injuries, from the wreckage. A second person was not seriously injured. Both were taken to Cape Cod Hospital.
Traffic was reduced to one lane and delays were expected until the truck could be removed. State Police are investigating the crash.

Man charged with rape of a child in Yarmouth
YARMOUTH - On Monday at 10:00 a.m., Detective Stephen Renzi arrested a man who was wanted for a sexual assault crime that occurred in Yarmouth.
The case was reported to the Yarmouth Police Department on November 10, 2012 and was brought to a conclusion when the suspect, identified as Bruce W. Fernandes, 58, of Hyannis, turned himself in to Yarmouth Police Headquarters this morning. The initial investigation was conducted by Yarmouth Police Patrol Officer Mark Noone with assistance from the Massachusetts Department of Children and Families as well as Children’s Cove.
Fernandes was charged with rape of a child with force and indecent assault and battery on a child under 14. He was processed and transported to the Barnstable District Court for arraignment.
Every six minutes, a child in the United Stated is sexually abused.

YPD disarms suicidal subject, confiscates weapons

YARMOUTH - On Sunday at 12:15 p.m., Yarmouth Police Dispatcher Stephen Peterson received information from the Samaritans that a man was loading up a shotgun and going to kill himself somewhere in the area of Fruean Way in South Yarmouth.
Under the direction of Patrol Sergeants Francis Hennessey and Gerard Britt, the following Yarmouth police officers responded to the area and secured the inner and outer perimeters: Patrol Officer Richard White, Patrol Officer George Tsoukalas, Patrol Officer Erica Wenberg, Detective Stephen Renzi and K9 Patrol Officer Michael Kramer.
Within a few minutes of their arrival, Detective Renzi spotted the 47-year-old South Yarmouth resident, carrying a loaded shotgun, walk from a camper on the property and enter the building. The man exited the building without the weapon a few seconds later and was taken in to control by the team of Officers. The man told officers he was despondent and suicidal and was provided on scene care and subsequently transported by members of the Yarmouth Fire Department to Cape Cod Hospital for evaluation and treatment.
A consent search was conducted of the Fruean Way business location as well as his home which resulted in numerous firearms being seized. Some of the weapons were:
· 3 Shotguns
· 2 Black Powder Long Guns
· 1 M4 Assault Riffle
6 Various Handguns
1 Compound Hunting Bow
Large Amount of Ammunition
All of the weapons located were unsecured. The man had a valid Massachusetts License to Carry the Weapons which was immediately revoked and he will be charged criminally with 12 Counts of Improper Storage of Firearms.
During the incident, a section of Old Town House Road was closed and traffic diverted with assistance of the Yarmouth Department of Natural Resources and the Massachusetts State Police.
Yarmouth Deputy Police Chief Steven Xiarhos said, "The Yarmouth Police Department appreciates the cooperation of all of the agencies involved and the patience of nearby citizens and motorists as we successfully resolved the situation in a short period of time with no one being injured or killed."

Infant death in Yarmouth not considered suspicious
YARMOUTH - On Saturday at 1:56 a.m. Yarmouth Police and Firefighters responded to a call at a home in Yarmouthport for a report of an infant not breathing.
Yarmouth Police and Firefighters located the infant at the residence and provided emergency CPR and Advanced Life Support. The Yarmouth Fire Department transported the infant to Cape Cod Hospital where despite all of the efforts of everyone involved the infant was unable to be resuscitated.
Yarmouth Police Detectives as well as Massachusetts State Police Detectives responded to the scene and are conducting a complete follow-up investigation.
At this point there is no indication of foul play and out of respect to the family involved there is no plan to release any further information at this time.

Odor evacuates Dunkin' Donuts plaza in Barnstable
BARNSTABLE - A burning odor forced the evacuation of the plaza housing the Dunkin' Donuts on Route 132 across from the Cape Codder. Apparatus from Hyannis and West Barnstable also responded. Some firefighters ascended the roof to check the ventilation system. After investigation it appeared a malfunctioning appliance was to blame. No injuries were reported.
Domestic dispute uncovers marijuana grow room
HYANNIS - On Sunday at approximately 5:07 a.m., the Barnstable Police Department received a 911 call about a female screaming for help in front of 119 Maple Street in Hyannis. After arriving on scene, officers found a hysterical female reporting that she had been assaulted by her boyfriend. The victim’s boyfriend, Dustin Johnson, along with another resident, Matthew Creswell, were located inside the home. Johnson was placed under arrest regarding the assault.
Officer Cronin asked Creswell if anyone else was in the home, or had been assaulted. Creswell granted officers permission to conduct a protective sweep of the home to check for other victims/witnesses.
Upon checking, Sgt. Cabral and Ptl. Cronin located a marijuana grow room in the basement of the home. The grow room was well constructed with special electrical utilities, lighting and venting. Also present were 20 marijuana plants ranging in size from six inches to four feet.
Creswell admitted that the grow operation was his and that he had been operating it for about a year.
Creswell was arrested and charged with Manufacturing/Cultivation of a class D substance (marijuana) and Possession with Intent to distribute a class D substance (marijuana).
Johnson was arrested and charged with assault and battery with a dangerous weapon (handbag), indecent assault and battery and assault and battery domestic violence.
Both subjects were bailed from the police facility and are scheduled to be arraigned in Barnstable District Court on Monday morning.

YARMOUTH - The Yarmouth Police Department reports the following: On Sunday, December 9, 2012 from 9:00 a.m. to 1:00 p.m., the men and women of the Yarmouth Police Department, the Yarmouth Police Relief Association, and the Yarmouth Police International Brotherhood of Police Officers Local 422 will join forces and collect food and other important items for those in need in our community.
This is our fifth bi-annual food drive and donations will be accepted to support the Yarmouth Food Pantry. Our goal is to continue to help stock the shelves and aid the dedicated pantry volunteers.
The Yarmouth Food Pantry is in need of the following supplies:
